On April 14, 2026, the Government approved the Extraordinary regularization 2026 through Royal Decree 316/2026, published in the Official State Gazette (BOE) on April 15th. It is the first mass regularization process in Spain in over 20 years. It allows undocumented foreign individuals to obtain a One-year residence and work permit, renewable.

It is estimated that around 500,000 people they can benefit. Online applications open on April 16th, and in-person applications open on April 20th. The deadline closes definitively on June 30, 2026.

With this permit you will be able to:

Important

Since your application has been accepted for processing, you are provisionally authorized to reside and work. Any deportation proceedings are suspended.

Can I apply for the extraordinary regularization in 2026?

Profile 1 — Undocumented individuals

If you arrived in Spain before January 1, 2026, and do not have legal documentation, you can apply for regularization by meeting the general requirements plus at least one of the three additional pathways.

Profile 2 - Asylum Seekers or International Protection Applicants

If you filed an asylum application before January 1, 2026, you can also benefit without needing to prove additional pathways.

Do you have a pending application?

If you filed for a residency permit before April 16, 2026, your permit will be granted directly, except for certain criminal records. Do not submit a new application — consult with a lawyer to confirm your situation.

Having worked as an employee or self-employed, or providing a job offer of more than 90 days or a responsible declaration as a self-employed worker.

Minor children, adult children with disabilities, or cohabiting first-degree ascendants.

🟡 Vulnerability Path

Accredited by social services or a Third Sector entity registered in RECEX. The irregular situation itself may be considered vulnerability.

No, unless a writ of attachment is filed before April 16, 2026.

Can I leave Spain while I'm proving the 5 months?

No. An exit, however brief, could cause you to not meet the uninterrupted stay requirement.
