Most frequent reasons for denial of regularization 2026
In previous regularization processes, the most common reasons for denial were:
- ❌ Incomplete or late documentation: Failure to respond to a request for correction within 15 days leads to the automatic archiving of the file.
- ❌ Failure to sufficiently prove the 5-month period of stay: undated documents, with incorrect names, or that do not cover the required period
- ❌ Criminal record in Spain, country of origin or countries of residence
- ❌ To have another residency application pending at the time of presenting
- ❌ Incorrect route selection not correctly accrediting the work, family, or vulnerability pathway
- ❌ Documentation without sworn translation or with uncertified translation
Types of resolution and what to do in each case
File closed for failure to respond to request.
If the Administration requested additional documentation from you and you did not provide it within the 15-day period, the file will be archived. In this case, the file is not a formal rejection And if the June 30, 2026 deadline has not passed, you could submit a new application.
Express denial resolution
If you have received a signed denial resolution, you have two avenues of appeal:
Motion for reconsideration
It is submitted to the same body that issued the resolution. Deadline: 1 month From the notification. It's the fastest and most economical way. Suitable when the reason for denial is a formal or documentary error.
Contentious-administrative appeal
Appears before the administrative litigation courts. Deadline: 2 months from the notification or from the dismissal of the motion for reconsideration. A lawyer and a court agent are needed.
When is it worth appealing?
Not all rejections are appealable with a chance of success. It's worth appealing when:
- The denial is based on an incorrect assessment of the documentation provided
- ✅ Denied due to lack of documentation, which was provided.
- The Administration incorrectly applied the criteria of the regulation.
- ✅ There are additional documents that could rectify the reason for denial.
It is usually not viable to appeal when the denial is based on current criminal records or objective failure to meet basic requirements.
If the June 30 deadline has not passed
If you receive a denial before the deadline and the reasons are correctable, it may be more efficient to submit a new, corrected application rather than filing an appeal.
⚠️ If you receive a denial, don't wait. Consult with an attorney in the early days to assess whether you appeal, file a new application, or explore other options.
